This push comes after the White House's earlier July 4 target was missed, with years of regulatory uncertainty having made it difficult for crypto businesses to operate confidently in the United States. Cuomo framed the issue plainly: "What the companies are saying is tell me the rules. Tell me the regulations. I need a referee. Just tell me where the lines are on the field and what I can do and what I can't do."

A Bill Looking for Bipartisan Ground

The Digital Asset Market Clarity Act would create a federal rulebook for issuing, trading and holding digital assets, dividing oversight between the Securities and Exchange Commission and the Commodity Futures Trading Commission, and defining how decentralized-finance developers and protocols would be treated.

In May 2026, the Senate Banking Committee advanced the CLARITY Act by a vote of 15-9, with all 13 Republicans joined by two Democrats. Those Democratic members signaled their committee votes did not guarantee floor support without further progress on an ethics provision addressing government officials' ties to the crypto industry.

Rather than blaming one political party for the delay, Cuomo warned lawmakers against turning crypto regulation into another partisan fight. He pointed out that cryptocurrencies began gaining traction around 2009, yet the U.S. still lacks a comprehensive regulatory framework, arguing the CLARITY Act would finally provide the legal certainty the industry needs.

A Closing Window

Cuomo's urgency is grounded in real legislative deadlines. The Digital Asset Market Clarity Act has already cleared the House, but as of early August it had not yet reached the Senate floor, though Senate Majority Leader John Thune said on August 3 that a vote would happen before the recess. Multiple reports indicate that missing that window resets comprehensive market-structure legislation to the next Congress, with enactment unlikely before mid-2027 at the earliest.

Cuomo has been direct about the competitive stakes: "The U.S. should pass the CLARITY Act. The rest of the world is already ahead of us." He co-chairs a joint venture between Intercontinental Exchange, the parent company of the New York Stock Exchange, and crypto exchange @OKX, a partnership aimed at building a regulated broker-dealer framework focused on tokenized assets. His growing profile in the debate reflects a broader shift in how Washington-adjacent figures are engaging with the crypto industry's push for federal rules.
