No Scheduled Action as Recess Looms

The Digital Asset Market Clarity Act is absent from the Senate's published floor plan for Monday, dealing the landmark crypto market structure bill another setback as lawmakers approach a summer break that many analysts consider the last viable window for passage in 2026.

The Senate's published floor plan for Monday contains no action on the CLARITY Act. Instead, senators are due to reconvene at 3 p.m., with the only listed roll-call vote at around 5:30 p.m. on cloture for the motion to proceed to H.R. 6500, a continuing-resolution vehicle.The chamber's cloture ledger, updated through July 31, likewise shows the July 30 filing on H.R. 6500 but no entry for H.R. 3633 or the Digital Asset Market Clarity Act, leaving leaders without a publicly listed floor path while the Senate's tentative calendar approaches an August state work period.

The Senate has shelved the crypto Digital Asset Market Clarity Act for the moment as it proceeds with different bills on Russian sanctions and federal nominations, further setting aside the industry's central policy effort and reducing its available runway in a crowded Senate agenda.Thune's office had told CoinDesk last week that his next floor-time priority would go to the Russia legislation.

What Is at Stake

The CLARITY Act is the most advanced crypto market structure bill in U.S. history. The House passed it on July 17, 2025, by a 294-to-134 margin, with more than 70 Democrats crossing the aisle.The Senate Banking Committee advanced the bill 15-9 during a formal markup hearing on May 14, 2026.On June 1, 2026, the CLARITY Act was placed on the Senate Legislative Calendar under General Orders as Calendar No. 423, making it formally eligible for full Senate floor consideration.

Failure to clear cloture before the August recess pushes the bill into a fall calendar that runs straight into November midterms, and a delay into 2027 risks restarting the framework before a Congress whose composition is unknown.The bill needs at least seven Democratic votes to clear the 60-vote cloture threshold before the August recess.Under ordinary Senate procedure, cloture filed midweek could allow a Friday vote on whether to proceed, not final passage, while a bipartisan petition or unanimous consent could accelerate the process before the August recess.

Negotiations are expected to continue in the days ahead, though the tightening calendar leaves little room for delay.
