Senate Democrats made a significant move Monday evening. Crypto analyst Diana (@InvestWithD) shared that just hours before today’s 2:15 p.m. procedural floor vote on the CLARITY Act, Democratic negotiators sent Republicans a counterproposal. GOP lawmakers had called their Sunday night text the “final” offer. Democrats answered with one of their own.

Democrats working on the bill met in Minority Leader Chuck Schumer’s office on Monday to align on their path forward. Senator Mark Warner confirmed the move as he exited the meeting.

“The Democrats who’ve been working on this in good faith are sending a counterproposal,” he said. Senator Raphael Warnock left the outcome open. “We’ll see where the Republicans land, and if they’re serious about a viable path,” he said.

Democrats Push Back on Ethics Language

The move follows Sunday night’s release of a revised Republican bill text. GOP sponsors described it as their final word on the matter, incorporating 126 substantive changes by Democrats over more than a year of bipartisan negotiations. Democrats disagree that the text goes far enough.

Some Democratic senators have said the ethics language in the GOP-released text is insufficient. The core concern centers on President Trump’s existing crypto interests. The Republican draft bars senior officials from issuing new digital assets and requires divestiture or placement in a qualified blind trust. President Donald Trump agreed to the new ethics provisions at the last minute.

Democrats want stronger language that more clearly addresses existing revenue-sharing arrangements and ensures durable enforcement beyond the current administration.

What Republicans Now Have to Decide

Industry sources expect the Democratic counterproposal to touch on most of the changes Republicans made Sunday night. That puts Republicans in a direct decision. They can accept elements of the Democratic offer and revise the text again, or they can hold firm and push Democrats to vote yes on the motion to proceed. If the bill passes, negotiations can continue on the Senate floor.

The Hours Ahead Are Critical

Pushing the bill forward carries some risk. Cloture requires 60 votes. Republicans hold 53 seats, meaning they need at least 7 Democrats to cross over. Without sufficient crossover support, the bill fails the procedural hurdle entirely. Senator Lummis has warned that a failed vote could delay the next real opportunity until 2030.

Democrats have responded with another offer. The next move belongs to the GOP. Whether they negotiate further or hold the line will likely determine the outcome of today’s vote and the future of U.S. crypto legislation this year.
