The Senate’s ongoing debate over the CLARITY Act has taken a sharper turn. Senator Cynthia Lummis and Senator Elizabeth Warren are now trading public accusations over the bill’s ethics provision, with Warren’s staff releasing a formal analysis and Lummis responding directly.

CoinDesk reported the exchange on X, capturing one of the most visible flashpoints in a months-long negotiation standoff.

What Warren’s Staff Calls It

The dispute centers on ethics language that Republican negotiators released on July 22. Warren’s minority staff on the Senate Banking Committee reviewed the text and concluded it was “riddled with major loopholes.” Their analysis argued the provisions would not prevent President Trump from continuing to profit from his cryptocurrency ventures.

Trump earned more than $1.4 billion from crypto in 2025 alone, according to financial disclosures. His ventures include the $TRUMP memecoin and World Liberty Financial.

Warren’s staff argued that even if the provisions technically applied to his profits, enforcement would fall to a Justice Department of his own choosing. This ethics debate has held up the bill for weeks.

Lummis Responds

Lummis rejected the Democratic analysis. She accused Warren of prioritizing opposition to Trump over protections for consumers, writing that Warren “hates President Trump so much that she’d rather have no rules of the road for the digital asset industry.”

She defended the ethics language on three specific points and described Warren’s fact sheet as dishonest. Lummis has consistently argued the goal of the provision is to build durable ethics standards across all three branches of government, not to target a single officeholder.

The Bill’s Current Position

The Senate Banking Committee advanced the CLARITY Act in May. Since then, the ethics question has stalled the bill on the Senate floor. A bipartisan counterproposal from Senators Thom Tillis and Ruben Gallego arrived at the White House Thursday.

It would give state attorneys general the power to sue the DOJ if it fails to enforce ethics laws against federal officials. A previous White House offer failed to win enough Democratic support. Senate Majority Leader John Thune also previously pledged a floor vote before the August 8 recess.

Lummis has closed the door on further negotiation. “I think we just vote and let the chips fall where they may,” she said. The White House’s response to the Tillis-Gallego proposal will determine whether a vote happens before recess.
