A Senate debate over crypto industry regulation is heating up. Senator Cynthia Lummis pushed back against a fact sheet released by Senator Elizabeth Warren’s office.

The document, published by the Senate Banking Committee’s Minority Staff, criticized the Trump-Republican ethics legislative language released July 22 in the new draft of the bill. Lummis responded with a point-by-point rebuttal.

The Stakes for the CLARITY Act

The CLARITY Act remains stalled in Congress. Lummis has warned that failure to pass the bill before recess could push its fate to 2030. The legislation aims to establish rules for the digital asset industry. Supporters argue consumers and law enforcement need a clear regulatory structure. Warren’s office argues the bill contains loopholes that benefit President Trump’s personal crypto holdings.

Warren’s Critique

The Senate Banking Committee’s Minority Staff fact sheet states Trump earned more than $1.4 billion from cryptocurrency ventures in 2025 alone. The document also claims the ethics provisions “do not restrict the primary ways Trump has raked in more than a billion dollars in crypto profits since he took office.”

The Minority Staff argues enforcement is left solely to the Department of Justice. State attorneys general and private parties are “specifically barred from ever bringing an enforcement action.”

The fact sheet also raises concerns about World Liberty Financial, noting Trump made $799 million from the platform according to his financial disclosures. The Minority Staff argues family members and Trump-affiliated entities could structure new ventures to avoid the bill’s restrictions.

Lummis Responds

Lummis rejected the characterization of the bill’s blind trust provisions. She cited 5 U.S.C. §13104(f)(3)(A) and 5 C.F.R. 2634.403, which bar a trustee from disclosing trust holdings to the official.

She argued that restriction is “literally what makes a blind trust blind.” The image she attached to her post shows the relevant regulatory text confirming that communications between an independent trustee and interested parties are restricted, with even non-trust matters subject to the prohibition.

On the $TRUMP memecoin, Lummis noted it launched before Trump took office. She argued the ethics ban applies to conduct during the presidency, not prior to it. On the question of adult children running World Liberty Financial, she stated federal ethics law has “never imputed financial interests from adult, independent children — only spouses and minor children.”

What Comes Next?

Both senators are building their cases before a potential recess deadline. Warren’s office focuses on enforcement gaps and existing revenue streams. Lummis believes the bill is ready, and argues that established law addresses the concerns Warren raises. The CLARITY Act’s timeline now depends on whether Congress acts before the break.
