The September 15 Senate cloture vote on the CLARITY Act is days away, and crypto content creator Austin Hilton is not optimistic.

In a recent video addressed to the XRP community, Hilton expressed visible frustration over the bill’s trajectory, telling viewers, “Looks like it’s just dying on a vine.”

The vote requires 60 votes to advance. All 53 Senate Republicans are committed to yes votes. Seven Democrats must cross the aisle, and right now, those votes are not there.

The Ethics Stalemate

The central sticking point is the ethics provision. Democrats want strong conflict-of-interest language covering President Trump and his family, citing Trump’s more than $1 billion in crypto earnings in 2025 tied to ventures like the $TRUMP memecoin and World Liberty Financial. Republican negotiators have released multiple revised versions of the ethics text, but Democrats continue to call it insufficient.

Senator Cynthia Lummis publicly wrote that “if this bill fails, it won’t be because of ethics.” She argued Democrats are demanding changes that “would give future regulators the ability to kill the crypto industry” and called for further Democratic compromise. Senator Mike Brown was more blunt, stating, “it does not look good right now.”

Hilton’s Take

Hilton was careful to separate politics from his analysis. He told viewers repeatedly to put their “political hat” down and view the situation as a “crypto citizen.” Still, he made his position clear. He said he believes Democratic opposition to Trump is “permeating all of this” and called the standoff “politics at its worst.”

“I am beyond pissed off about this,” Hilton said. He acknowledged the ethics dispute has a real basis, accepting that Trump did earn substantial money from his crypto ventures. His frustration centers on the cost to the industry. He sees the CLARITY Act as necessary to keep the U.S. competitive in crypto.

The 2030 Problem

The calendar makes failure especially costly. Lummis has warned publicly that if the bill does not pass this Congress, the next realistic opportunity for market structure legislation is 2030.

The House canceled the final two weeks of its September session, leaving Washington by September 17. If the Senate passes an amended bill, the House must approve those changes, and no members will be present to do it.

Hilton reacted to the 2030 timeline with alarm. “Why are we losing three and a half, almost four years to this?” he asked. He described the loss as damaging to everyone in the crypto ecosystem.
