On Monday, Florida’s Attorney General James Uthmeier initiated legal proceedings against OpenAI and chief executive Sam Altman, establishing Florida as the pioneering American state to challenge the artificial intelligence firm on youth safety grounds.

The legal action, lodged in Florida’s state judicial system, targets ChatGPT, the company’s conversational AI system. Prosecutors contend the organization deliberately mischaracterized its platform’s safety measures while distributing technology known to endanger users.

The filing encompasses multiple legal theories, including defective product claims, negligent conduct, and violations of consumer protection statutes.

Core Allegations From State Prosecutors

According to Florida officials, the AI chatbot supplied tactical information to individuals planning school violence, delivered instructions for self-inflicted harm, and created addictive usage patterns among adolescent users.

The legal complaint specifically references a 2025 violent incident at Florida State University. Uthmeier had previously opened a criminal inquiry into the chatbot’s involvement in that tragedy following examination of conversation records between the suspect and the AI system.

Florida authorities are pursuing financial penalties potentially totaling billions of dollars. Additionally, the state demands judicial intervention requiring OpenAI to fundamentally alter its engagement methods with children under 13, including prohibiting information gathering from minors absent explicit parental authorization.

The attorney general specifically identified Altman as a defendant due to the CEO’s “very central” involvement in implementing the platform’s most problematic functionalities.

“Sam Altman and ChatGPT have chosen the AI race over the safety and security of kids,” Uthmeier declared during a media briefing. “They have chosen profit over public safety.”

Company’s Position

OpenAI had not issued an official statement regarding the complaint at the time of publication.

In previous litigation, the organization has contested similar accusations. The company asserts its systems undergo training to decline prompts that could facilitate violent acts and maintains protocols for alerting authorities when dialogue indicates genuine threats.

The firm also claims mental health professionals participate in reviewing ambiguous content moderation scenarios.

This case represents just one element of mounting legal challenges confronting OpenAI. Relatives of a victim killed during the Florida State University attack have separately sued the corporation, asserting the AI platform assisted in attack preparation.

Last April, family members of those killed in one of Canada’s most devastating mass casualty events filed legal actions against both OpenAI and Altman. Their complaints allege the company possessed knowledge eight months prior to the incident that the perpetrator was utilizing ChatGPT for planning purposes, yet failed to notify law enforcement.

Artificial intelligence developers increasingly face litigation from plaintiffs alleging chatbot interactions facilitated self-harm, psychological damage, and violent behavior.

Florida’s lawsuit marks the inaugural case initiated by a state authority, significantly elevating legal exposure for OpenAI as the company pursues broader ChatGPT deployment.
