Could SEC-CFTC Guidance Become XRP’s Regulatory Lifeline if the CLARITY Act Stalls? 

With the Senate missing its chance to vote on the CLARITY Act before the August recess, September is shaping up to be a critical month for U.S. crypto regulation.

Renowned crypto observer SMQKE recently highlighted a possibility that could become increasingly important: if CLARITY fails, the industry could fall back on existing SEC-CFTC crypto guidance. Well, this prospect matters for XRP.

The Securities and Exchange Commission (SEC) and Commodity Futures Trading Commission (CFTC) issued a joint interpretation in March 2026 that treats XRP as a digital commodity. If the CLARITY Act ultimately stalls, that interpretation could become an important regulatory foundation for XRP and the wider crypto market.

What Would It Mean for XRP?

The biggest takeaway is regulatory clarity. Treating XRP as a digital commodity gives market participants a clearer starting point when determining how the asset should be handled under U.S. rules. This could be particularly relevant for exchanges, financial institutions, payment companies and asset managers considering XRP-related products and services.

For XRP, the distinction could also help reduce one of the industry's biggest concerns: uncertainty over whether the asset itself should be treated as a security.

A clearer regulatory classification could make it easier for U.S. businesses to build around XRP and the XRP Ledger without constantly facing questions over its regulatory status. It could also strengthen the case for institutional involvement, where predictable rules are often essential before companies commit significant capital and resources.

But there is a major catch because the SEC-CFTC guidance is not the same thing as Congressional legislation.

The CLARITY Act is intended to create a broader statutory framework for digital assets and establish clearer boundaries between regulators. If Congress passes it, the industry would gain rules backed by legislation rather than relying primarily on agency interpretation. If the bill fails, that certainty could remain out of reach.

Why September Could Matter

The Senate's missed pre-recess window has shifted attention toward September. A successful CLARITY vote could give XRP and the broader crypto industry a more durable regulatory framework.

A failure, however, would not necessarily send XRP back to square one.

Instead, the March SEC-CFTC interpretation could become even more important. For XRP, maintaining digital-commodity treatment would provide a regulatory foundation for exchanges, institutional products, payment applications and continued XRPL development.

This does not mean a CLARITY failure would automatically push XRP's price higher. Regulation is only one factor driving the market.

Still, the scenario creates an intriguing distinction that CLARITY passing could deliver legislative certainty, while CLARITY failing could make the existing SEC-CFTC framework, and its treatment of XRP as a digital commodity, even more significant.

For XRP holders and the wider crypto industry, September may therefore be more about which form regulatory clarity ultimately takes.
