Two prominent cryptocurrency advocacy organizations, the Crypto Council for Innovation (CCI) and the Blockchain Association, have taken legal steps to accelerate judicial review of Illinois’s planned digital asset tax. Both groups submitted their request to the Circuit Court of Sangamon County on Tuesday, urging an expedited timeline for summary judgment on the measure’s legality.

Push to expedite ruling on Illinois digital asset tax

The advocacy groups are seeking a swift court decision to clarify whether the state’s 0.2% tax on crypto asset transactions aligns with legal standards. Summary judgment would let the court resolve the dispute without proceeding to a full trial, a measure both organizations said could benefit stakeholders seeking regulatory clarity.

“To reach a decision on the tax’s lawfulness as quickly as possible,” CCI and the Blockchain Association said in their request. If the court grants the accelerated schedule, a ruling could be issued as early as March, well ahead of the tax’s rescheduled start date.

While pausing enforcement of the Digital Asset Tax Act protects Illinois consumers and businesses from this onerous and legally flawed tax until July 1, it remains imperative that the merits are determined as soon as possible, said CCI CEO Ji Kim.

The lawsuit aims to challenge the Digital Asset Tax Act, which applies a 0.2% levy on digital asset transactions in Illinois. Advocates claim that the legislation was included in the state’s budget with minimal public involvement.

The CCI represents industry leaders working toward responsible crypto regulation, while the Blockchain Association acts as a policy and advocacy group for the US digital asset sector.

Multiple lawsuits and recent delay

The current legal battle features two lawsuits challenging the Digital Asset Tax Act. In addition to the joint case brought by CCI and the Blockchain Association, the Digital Chamber and the Illinois Blockchain Association have initiated a separate lawsuit addressing the same statute.

Earlier this month, Illinois officials agreed to push back the tax’s enforcement to July 1, 2027, instead of its original January launch. This delay is part of negotiations during the legal proceedings and offers more time for the courts to consider core arguments against the tax.

Digital Chamber CEO Cody Carbone stated that the organization will keep up its legal challenge until the tax is permanently removed. The Digital Chamber is an industry group focused on advocating for policies that support digital assets and blockchain technology.

Leadership shifts at the Blockchain Association

These court filings arrive during a period of executive change at the Blockchain Association. CEO Summer Mersinger, who joined in 2023 after her role at the US Commodity Futures Trading Commission, is preparing to step down on Friday.

Kristin Smith, the association’s former CEO, will return to serve as interim leader. Mersinger is expected to remain with the organization through the end of 2026 in an advisory capacity.

With the tax’s enforcement now delayed, Illinois residents and businesses remain unaffected until at least July 2027. The final implementation will depend on the outcome of ongoing legal proceedings, which could be settled several months in advance if the new accelerated schedule is accepted.
