The ethics provision has been the central sticking point in months of Senate negotiations. The clause also points at the president, whose July 1 financial disclosure logged roughly $1.4 billion in crypto income for 2025, most of it tied to World Liberty Financial and his memecoin.
Multiple industry sources reported that negotiations had reached a breakthrough after the White House approved an ethics package and shared draft language with several Senate Republicans. However, the path to a floor vote remains narrow. Democrats say they have been largely excluded from ethics negotiations in recent weeks, and the agreement was struck between the administration and two Republican senators, with the text shared with Republicans rather than with the members who set the ethics conditions.
Senate Calendar Adds Pressure
The Clarity Act is built around establishing a comprehensive federal market-structure framework for digital assets. It passed the House in July 2025 and cleared the Senate Banking Committee in May 2026. The legislation seeks to clarify the roles of the SEC and CFTC, with the Agriculture Committee portion giving the CFTC authority over digital commodity intermediaries and imposing registration, custody, anti-fraud, and customer property requirements.
Republicans hold 53 Senate seats, but passage requires 60, meaning at least seven Democrats must cross over, and none have yet signed on to the new language. Time is also a factor. The Senate breaks for recess around August 8, leaving Majority Leader John Thune a tight runway to schedule a floor vote. Polymarket traders raised the odds of the Clarity Act becoming law this year to around 43% following the ethics breakthrough reports, up from 32% the prior Friday.
