Lummis Pushes for Pre-Recess Vote
Senator Cynthia Lummis (@SenLummis) told Fox Business on August 5 that she believes the Senate will vote on the CLARITY Act before the August recess, warning that lawmakers may not leave Washington on Friday and could work into the weekend to get it done. The statement is the latest in a string of public commitments from Lummis, who has been the bill's lead sponsor throughout a legislative process that has stretched across more than a year.
Despite the optimistic tone, the path forward remains narrow. The CLARITY Act has yet to be placed on the calendar for a floor vote and has been sitting on the Senate Legislative Calendar since June 1. The bill now has just days to clear the chamber before lawmakers leave for the August recess. Senate Majority Leader John Thune controls the floor schedule, and while Lummis has said he has reserved space for the bill, no formal scheduling notice has been filed.
60-Vote Threshold and Bipartisan Hurdle
Clearing the Senate requires 60 votes to overcome a filibuster, meaning Republicans need significant Democratic support. That remains the central challenge. A Senate Banking Committee minority staff analysis renewed Democratic objections that the bill preserves pathways for President Trump to continue profiting from crypto ventures, after disclosures showed about $1.4 billion in 2025 earnings tied to his crypto activities.
The CLARITY Act has already cleared the House by a 294-134 margin in July 2025 and cleared the Senate Banking Committee through a 15-9 bipartisan vote in May 2026. Supporters argue the legislation would provide a durable statutory framework for crypto oversight. The SEC and CFTC's joint interpretive guidance classifying digital assets can be rescinded overnight by any future administration without a congressional vote, and only a statute survives a change of administration intact.
Prediction markets reflect deepening skepticism about the bill's near-term prospects. Polymarket currently prices 2026 passage at just 16%, down sharply from highs above 80% earlier this year. Galaxy Research has also cut its estimated probability of CLARITY Act enactment in 2026 from 50% to 30%. Miss the pre-recess window, and the bill's momentum almost certainly stalls until 2027.
