Brussels is weighing whether to extend its landmark crypto rulebook to cover DeFi lending vaults, a move that could reshape how onchain credit markets operate across Europe.

A Regulatory Gap Under the Microscope

On May 20, 2026, the European Commission asked stakeholders to weigh in on areas left outside the original Markets in Crypto-Assets (MiCA) framework, including issues around decentralised finance and crypto lending and borrowing.The targeted consultation has been extended to September 30, 2026, and may ultimately lead to legislation amending or complementing MiCA.

One area of particular contention involves lending vaults, which can channel billions of dollars into onchain credit markets without looking like conventional lending.Their legal status currently depends on non-binding interpretations that they fall outside MiCA and EU fund rules.Responsibilities in many vaults are split among code and distinct roles rather than concentrated in a single company, making it unclear which person or entity would fit existing regulatory categories.

Classification by Function, Not by Name

Lending vaults remain difficult to classify because they can distribute roles across smart contracts and multiple participants rather than operating through a single, clearly identifiable service provider. Legal experts say the absence of a defined category in EU law is central to the problem. As one EU digital assets lawyer put it, "EU law has no category called a 'vault.' A lawyer therefore defines it the way a regulator would qualify it: by function, not by label."

Legal experts argue that regulators should avoid collapsing DeFi lending into a single bucket, since different vault designs can have materially different economic functions and control dynamics.Michael Egorov, founder of Curve Finance, argued that rules for DeFi lending should differ from those for traditional finance, saying DeFi may not need some conventional safeguards while requiring others.

The Commission is considering criteria such as admin keys, concentrated governance, custody, identifiable operators, and marketing activity when determining whether a DeFi protocol is genuinely decentralised.The Commission asked stakeholders to comment on whether lending and borrowing should be added explicitly to the list of regulated crypto-asset services or addressed through a different approach.

The consultation closes September 30, and what follows could determine whether lending vaults remain outside MiCA or become subject to a new regulatory framework. For Brussels, the challenge is not simply whether to regulate DeFi lending, but how to write rules that distinguish between very different forms of onchain lending and the people, if any, that actually exercise control over them.
