Why Minnesota and Prediction Platforms Ended Up in Court

Minnesota moved against prediction markets earlier in the summer, with the state’s attorney general pressing the case in a June 18, 2026 statement on prediction markets.

The restriction itself is tied to state legislation, Minnesota Senate File 4511, published on the state revisor’s site. The bill frames the state’s authority to limit these markets within its borders.

The platforms argue federal oversight preempts the state. Prediction market operators have positioned event contracts under the Commodity Exchange Act, which places commodity derivatives under federal CFTC jurisdiction.

That sets up a turf war over who gets to police event contracts. The tension between state consumer-protection power and federal commodities regulation is what the judge must ultimately resolve, and the outcome would reach well beyond Minnesota.
