Federal legitimacy for Ripple and XRP may not depend on Congress moving at all. Crypto researcher SMQKE (@SMQKE) highlighted an analysis from Fintech Weekly showing that Ripple is actively pursuing an OCC charter alongside its lobbying efforts for the CLARITY Act.
The Fintech Weekly piece notes that companies like Circle, Ripple, and Coinbase “have also been among the most active lobbyists for the CLARITY Act.”
At the same time, those same companies are filing for OCC charters. The article states they are “pursuing both routes because both are open, and because they cannot afford to bet the business on either one alone.”
Where the CLARITY Act Stands
The CLARITY Act is closer to a Senate vote than recent reports suggested. Senator Bernie Moreno pushed back publicly against claims that the bill still had unresolved issues. He stated that an agreement was reached weeks ago and that all parties are expected to honor their commitments.
He also confirmed that 11 months of negotiations between Senate Republicans and Democrats have officially concluded. He also stated that all 53 Republicans will vote to advance it.
The Importance of the OCC Charter
The OCC charter gives Ripple access to the federal banking regulatory framework independent of legislative progress. This is a meaningful development for institutional adoption, and Ripple already secured conditional approval.
Financial institutions require regulatory clarity before integrating new technology at scale. An OCC charter delivers that clarity through an existing, well-understood federal structure. It removes a major barrier without waiting for new legislation.
Multiple Scenarios With One Direction
The Fintech Weekly analysis outlines three possible legislative outcomes. If the CLARITY Act passes with yield provisions intact, stablecoin issuers gain statutory authorization to compete with bank savings products. If it passes without yield provisions, companies gain regulatory clarity but lose that specific competitive tool.
If it does not pass at all, the article states, “the OCC charter becomes the primary vehicle for federal legitimacy, and the stablecoin yield question gets resolved through a future rulemaking rather than legislation.” Ripple’s positioning covers all three scenarios. No single outcome shuts the door on institutional adoption.
Price and Adoption Outlook
XRP’s adoption case strengthens as its regulatory position becomes more defined. Institutional buyers need legal certainty before making meaningful allocations. The OCC charter pathway provides that certainty now.
