SEC Schedules August 14 Vote on Regulation Crypto
The U.S. Securities and Exchange Commission has called an open meeting for Friday, August 14, with a single item on the agenda. Commissioners will vote on whether to propose Regulation Crypto, a new offering regime designed to create a regulated path for digital asset issuances. The SEC is about to propose its first formal rule that sets more durable rules for crypto businesses, in this case a regimented path for legal issuance of digital assets under "Regulation Crypto."
SEC Chairman Paul Atkins has long set the goal of this rulemaking as one of the major points of his crypto regulatory plan, and the agency has scheduled August 14 for the meeting at which the three-member commission will open the proposal for public comment. The meeting notice landed on Monday night with unusually short lead time, drawing immediate attention across the industry.
What Regulation Crypto Would Mean for Projects
The rulemaking package covers registration exemptions for token launches, a safe harbor for teams decentralizing away from managerial control, broker-dealer custody treatment, and trading-venue structure. In practical terms, this would give crypto projects a path to raise capital without triggering full securities registration requirements. Teams could also exit SEC jurisdiction once a network is no longer actively managed, removing a long-standing source of legal uncertainty for decentralized protocols.
The agenda includes plans to clarify rules for crypto capital raising, digital asset custody, and onchain trading of tokenized securities. The Commission recognizes the importance of advancing its regulatory framework to reflect the realities of today's operating environment, and aims to bring more products onshore by creating clear rules for capital raising with crypto.
The vote also arrives at a notable moment for U.S. crypto legislation more broadly. The meeting comes just a week after the U.S. Senate left town without holding even a procedural vote on the CLARITY Act, which is intended to clarify how the SEC and the Commodity Futures Trading Commission can oversee crypto. If Congress delays broader legislation, SEC rulemaking may become a key path for near-term crypto regulation.
