White House officials held discussions with Republican Senators Cynthia Lummis and Bernie Moreno to finalize ethics requirements within the legislation. According to a White House representative speaking to CoinDesk, the administration endorsed “the most comprehensive and wide-ranging ethics provision in history.”

Understanding the CLARITY Act

The CLARITY Act represents a comprehensive crypto regulatory framework that secured House approval in July 2025. The legislation has remained stalled in the Senate due to conflicts surrounding ethics requirements, stablecoin regulations, and protections for software developers.

The legislation seeks to establish a comprehensive regulatory structure for digital assets across the United States. While numerous crypto executives and legislators have endorsed the measure, Senate passage demands 60 affirmative votes — a challenging threshold considering Democratic resistance.

Ethics Debate Continues

The primary sticking point centers on enforcement authority. Democratic lawmakers advocate for state-level prosecutors to enforce cryptocurrency ownership prohibitions on government personnel. Conversely, the White House and Republican legislators support granting this power to the federal attorney general.

Democratic senators contend that the federal attorney general maintains insufficient independence from the executive branch. Trump has nominated Todd Blanche, his former personal attorney, for this position.

The contemplated ethics framework would apply to the president, vice president, and every congressional member. This creates complications regarding Trump’s personal cryptocurrency investments, including his involvement with World Liberty Financial and his memecoin venture.
