The Digital Asset Market CLARITY Act is inching toward a Senate floor vote, but the window is narrowing fast. Speaking to Fox Business, Senator Kevin Cramer (@SenKevinCramer) described the crypto market-structure bill as "almost there," while Treasury Secretary Scott Bessent (@SecScottBessent) placed it on the "1-yard line" and called for a vote before the August recess. Cramer, however, stopped short of committing to a specific date.
Ethics Holdouts Remain the Biggest Obstacle
The optimism from Republican lawmakers comes with a significant caveat. Ethics provisions remain a sticking point, alongside concerns from law enforcement and banks over developer protections and yield. The bill needs 60 votes to clear a Senate cloture motion, and that arithmetic is tight. With Senators Josh Hawley and Rand Paul expected to vote no, and Senator McConnell's continued medical absences compounding the thinned majority left by Senator Lindsey Graham's death on July 11, Galaxy Digital research head Alex Thorn has estimated that Senate leadership may need as many as seven to nine Democratic crossovers to hit the 60-vote threshold.
So far, only two Democrats voted for the bill in committee, both with conditions attached to any floor support. Polymarket odds rose to about 43% on Monday, compared to 32% on Friday,after reports that President Trump accepted an ethics provision that had stalled the bill. The trajectory: 32% on Friday, climbing to 43% by Monday on the back of the Trump ethics-deal reports. No official statement from the White House has been issued and revised bill text has not been released, though the breakthrough carries an unresolved problem: the senators whose votes it is meant to secure have not yet seen it.
A Shrinking Calendar and Rising Stakes
Beyond the vote count, time itself is a constraint. The Senate breaks for recess around August 8, leaving Majority Leader John Thune a tight runway to schedule a floor vote.Thune has pledged a floor vote before the August recess, with the week of July 20 now under active discussion as the target. The process to advance the legislation through cloture alone could consume several of those days, and floor-time competition from the September funding deadline and reconciliation fights further complicates the schedule.
Brian Gardner, chief Washington policy strategist at Stifel, has written that the bill "probably needs to get through the Senate by the end of July" and that missing the August recess would cause its prospects to "deteriorate materially." Beacon Policy Advisors has been more blunt, characterizing a miss as potentially ending the 2026 path entirely.
Even if the Senate acts, the House would still need to approve whatever merged text emerges. The House passed the bill with bipartisan support back in July 2025. House members are in session only through July 23, leaving a tight window for any coordinated action. If passed, the CLARITY Act would establish a federal framework for digital asset markets by drawing a clearer line between assets regulated by the SEC and those overseen by the CFTC.
