Stablecoins: Risk Ban in the USA or Mandatory Compliance by 2027

The US banking regulator sets a strict ultimatum for the crypto industry. The Office of the Comptroller of the Currency (OCC) has officially published the final rule for implementing the GENIUS Act. From now on, stablecoin issuers face a hard deadline set for January 18, 2027. After this date, any non-compliant entity or unable to guarantee 100% backing will be banned from the US market.

In brief

  • The OCC enforces the implementation decrees of the GENIUS Act for the entire US banking system.
  • Stablecoin issuers have until January 18, 2027, to comply, under penalty of a complete ban on operating in the USA.
  • Obligation to cover each crypto token with real cash or US Treasury bonds, backed by regular audits.
  • Stablecoin reserves will be safeguarded to reimburse crypto users as an absolute priority.

Stablecoin Issuers Banned in the United States Starting 2027 for Non-Compliance

The stablecoin industry, which represents a major pillar of the crypto market with over $270 billion in market capitalization, is entering an accelerated phase of regulation. With the publication of the GENIUS Act final rules by the OCC, the US legal framework no longer leaves any room for ambiguity.

To continue operating in the United States or maintain partnerships with traditional financial institutions, stablecoin issuers must obtain the status of authorized issuer (Permitted Payment Stablecoin Issuer). The OCC was very clear. Companies that do not meet all licensing criteria by January 18, 2027, will face a strict ban on issuance and circulation in the US market.

Final Rule Requirement (OCC) Issuer Obligation Sanction / Impact on Crypto Ecosystem Banking license (PPSI) Formal registration with the OCC or the Fed Immediate ban on operating in the USA 100% Guaranteed Reserves Exclusive backing in cash and US Treasury bonds License revocation and token freeze Priority in case of bankruptcy Legal segregation of funds for customers’ benefit Administrative and criminal sanctions Transparency and governance Independent third-party audits and certified monthly reports Exclusion from regulated crypto exchange platforms OCC data.

Stablecoin: The End of Opacity in the Crypto Market

To avoid risks of financial destabilization or bank panic (bank run), the GENIUS Act rule promulgated by the OCC bans the use of risky assets, private debts, or unsecured bonds in stablecoin reserves. As Jonathan V. Gould, acting head of the OCC, said.

Today’s final rule provides a clear and practical framework for payment stablecoin innovation, accompanied by strict requirements regarding reserve backing, redemption, and risk management.

Each digital dollar must thus be backed 100% by real bank liquidity or short-term US Treasury bonds. Furthermore, the law reinvents the security of crypto users. Now, in the event of liquidation or issuer bankruptcy, the entirety of the reserves will be legally protected to reimburse token holders as an absolute priority before banks and creditors.

The GENIUS Act Forces Massive Ecosystem Consolidation

This regulatory offensive by the OCC aligns with Washington’s goal of establishing dollar supremacy in the digital era while cleaning up the crypto market. By setting extremely high entry barriers, the United States triggers a decisive countdown for issuers.

Stablecoin giants like Tether and Circle have more than a few months (until January 18, 2027) to adapt their infrastructure and governance. By 2027, this strict compliance requirement should cause widespread market restructuring, eliminating opaque projects in favor of operators able to offer first-class banking guarantees.

By mandating obligatory compliance with GENIUS Act requirements before 2027 under penalty of a ban in the USA, the OCC sets the rules for a stablecoin market now backed by traditional banking standards. Do you think this threat of a ban will force all major crypto market issuers to comply with American demands before 2027?
