Switzerland's Financial Market Supervisory Authority (FINMA) has approved the country's first spot Bitcoin ($BTC) exchange-traded fund for retail investors, allowing a fund to hold the cryptocurrency directly under Swiss investment fund rules.
What FINMA approved
According to FINMA's announcement, the regulator noted growing interest in cryptocurrencies, particularly Bitcoin, and for the first time approved an exchange-traded retail fund that invests directly in the asset. The product is classified as an "other fund for alternative investments" with a specific risk under Swiss law.
FINMA also granted an exemption from the applicable risk diversification rules. The regulator said Bitcoin's long trading history and particularly high trading volume compared with other cryptocurrencies justified the exception in this case. Funds sold to the public are normally expected to spread their money across many holdings, as Crypto Briefing noted. The same outlet said the reasoning is specific to Bitcoin rather than to crypto as a category.
Switzerland is not new to crypto investment products. The Block reported that the SIX Swiss Exchange has listed Bitcoin exchange-traded products for years, and that FINMA authorised a crypto fund for qualified investors in 2021. The newly approved ETF, however, falls under a different regulatory framework for investment funds.
Conditions and risks
The approval comes with conditions. PANews reported that FINMA requires the regulated institution to take measures to reduce operational and custody risks, and to clearly disclose Bitcoin price volatility and potential loss risks in the fund documents. When sold, the product must also comply with conduct rules under the Financial Services Act (FinSA), including appropriateness and suitability assessments.
On custody, Crypto Briefing said the requirements stem from guidance FINMA published on January 12, 2026, which set out risk-mitigation measures for institutions handling these products.
FINMA stressed that approval does not change the underlying risk. The Block said the regulator described Bitcoin as highly volatile, with investors potentially losing a significant portion of their money.
The regulator did not name the issuer. Other fund providers have submitted or announced applications for Bitcoin ETFs, according to FINMA, which suggests more Swiss products could follow.
