“THE CLARITY ACT IS NOT TECHNICALLY DEAD,” the analyst wrote. The reasoning centers on Senator Thom Tillis. Tillis voted no on a procedural motion to recommit. That specific move preserves the possibility of bringing the bill back for reconsideration. It is a legislative tool, not a rejection of the bill itself.
The Window Is Closing
EGRAG CRYPTO’s accompanying graphic laid out the timeline. The Senate remains in session only through October 2. That leaves 12 session days. Every failed vote burns roughly 2 days of that calendar. A renewed attempt could theoretically come as early as Thursday, September 17.
The window is tight. Even if Senate leadership schedules another vote and clears the 60-vote threshold for cloture, the bill still has to reconcile with the House. House members were scheduled to leave Washington by September 17. That two-day overlap between the Senate schedule and House departure makes the logistics difficult.

The CLARITY Act would have established a federal regulatory framework for digital assets. It would have split jurisdiction between the SEC and CFTC, giving each agency defined authority over different asset classes. XRP has regulatory clarity, but this bill would’ve extended it to the broader market and reinforced institutional interest.
XRP’s price declined after the vote, and the asset has yet to show positive signs. In early September, Senator Cynthia Lummis warned that a failure in this Congress pushes the next realistic opportunity to 2030. That warning is now more relevant than ever as the midterm approaches.
What Comes Next?
EGRAG CRYPTO’s message urges the crypto community to watch Washington closely. He believes the bill is not finished, but the conditions for reviving it are narrow. Few in the community share that view, as many commenters pushed back against his claims.
However, one commenter noted that the SEC could perform the same regulatory function without needing a vote. SEC Chair Paul Atkins recently said regulatory guidance without statutory backing will lack durability, but the SEC and CFTC will continue issuing rules.
