The bill still faces a long road, including a full House vote, Senate approval, and a presidential signature. But the committee advance formalizes something that already exists in practice: the federal government holding onto seized Bitcoin instead of selling it off.

Bitcoin Strategic Reserve Bill Details: What It Actually Requires

The legislation, known as H.R. 8957 or the American Reserve Modernization Act, builds directly on an executive order President Trump signed in March 2025 that created the reserve in the first place.

Key provisions in the version that just advanced include:

  • Treasury would centralize custody of forfeited Bitcoin in one secure facility

  • A minimum 20-year holding period applies before major sales become possible

  • Annual public reporting and audit requirements replace the earlier quarterly proposal

  • A study on budget-neutral ways to grow holdings, without new taxes or borrowing

  • States can opt into segregated custody arrangements voluntarily

  • Private ownership and self-custody rights stay explicitly protected

The government currently holds an estimated 324,000 to 328,000 BTC, worth close to $24 to $25 billion at recent prices, largely tied to forfeitures from cases like Silk Road and the Bitfinex hack recovery. 

Exact figures still vary between trackers, since no single official audited balance sheet exists yet. 

Bitcoin News Today: How the Bill Moved Through Committee This Year

The path to this week’s vote started back on May 21, 2026, when Rep. Nick Begich introduced H.R. 8957 with Rep. Jared Golden as a co-lead. The bill then sat with the House Financial Services Committee for several months before reaching a markup.

Compared to earlier Bitcoin reserve proposals, this version stayed narrower. It dropped an earlier idea requiring the government to purchase a full million BTC, focusing instead on locking down what has already been seized and adding transparency around it.

The September 16 markup saw a substitute amendment adopted that softened some original terms, including stretching reporting from quarterly to annual and adjusting when the 20-year clock starts counting. 

A separate Democratic amendment was rejected during the same session, and the final vote broke almost entirely along party lines.

US Crypto Bill Legislature 2026 Faces a Mixed Week in Washington

The Bitcoin reserve vote landed just one day after a rougher outcome for crypto policy overall. On September 15, the Senate failed a cloture vote on the CLARITY Act by 49 to 50, falling short of the 60 votes needed to move forward.

Disputes over restrictions on senior officials profiting from crypto, including concerns tied to the Trump family's holdings, played a central role in the breakdown.

The same day the Bitcoin reserve bill advanced, a separate bill also moved forward with much stronger support. The Digital Asset Tax Certainty Act cleared the House Ways and Means Committee by a 38 to 5 vote, aiming to set clearer tax rules around small transaction fees, staking income, and crypto donations. 

Both crypto regulation bills still need full House and Senate approval before becoming law.

On the crypto ETF side, spot Bitcoin funds saw ~$296 million ($295.9M) in net outflows on September 16, while spot Ether ETFs lost another $224 million, bringing combined outflows to about $520 million for the day.

BlackRock's IBIT logged the largest single BTC ETF redemption at $144.11 million, followed by Arc Shares’ $84.4 million.

Crypto Regulation 2026 Outlook: What’s Next for BTC Price Recovery

A full House floor vote on the Bitcoin reserve bill looks unlikely before the November midterms, since lawmakers were set to leave Washington shortly after the markup. 

Prediction markets have placed the odds of the bill becoming law by 2027 at roughly 6% or lower, reflecting a tight calendar and the recent CLARITY Act stall.

Stablecoin rules already sit on firmer ground under the GENIUS Act, with final implementation still expected around January 2027. For everything else, agency-level rulemaking from the SEC and CFTC looks like the more realistic near-term path while Congress works through its calendar.
