Crypto Tax Notice in India Explained Through the NUDGE Drive

A crypto tax notice has become a real worry for Indian traders after thousands of emails and messages reached taxpayers with unreported digital asset income. The Income Tax Department sent them under a campaign named NUDGE.

Most of these messages are not formal demands. They ask taxpayers to review a filed return and correct any crypto income missing from it, which makes a NUDGE email a softer step than a legal crypto tax notice.

What Is the NUDGE Drive and Who Runs It?

NUDGE stands for Non-Intrusive Usage of Data to Guide and Enable. The Central Board of Direct Taxes (CBDT) runs it as an outreach program that uses data analytics to find gaps in returns already filed.

Crypto is the third phase of the campaign, and the crypto tax notice emails followed two earlier rounds on foreign asset disclosure and wrongful deduction claims under Section 80GGC.

Under Indian tax law, a virtual digital asset (VDA) covers cryptocurrencies, non-fungible tokens, and other digital assets. Indian currency, central bank digital currencies, and foreign currency sit outside that definition.

The government frames the exercise as awareness-led. In replies to Parliament during 2025, it said 44,057 emails and messages went to select taxpayers who traded or invested in VDAs but left them out of Schedule VDA.

What Triggers a Crypto Tax Notice From the Department?

Data analytics flagged taxpayers who either skipped the schedule entirely or reported crypto income wrongly, and each flagged case became a potential crypto tax notice. Typical errors included applying a lower tax rate or claiming cost indexation, which the law does not allow.

The department compared income tax returns with TDS returns filed by virtual asset service providers, meaning exchanges and similar platforms. Parliament was also told that analytics tools and Project Insight help match VDA transactions with what a return discloses.

A Lok Sabha reply in December 2025 gave a sense of scale. It reported Rs 888.82 crore of undisclosed VDA income found during search and seizure operations, a figure that came from raids and not from the emails themselves.

Which Tax Rules Sit Behind a Crypto Tax Notice?

India taxes crypto through a dedicated framework introduced in 2022. Three provisions matter most when a return is checked against exchange data and a crypto tax notice is considered.

Provision

What It Says

Why It Matters

Section 115BBH

Flat 30% tax plus surcharge and cess

Only the cost of acquisition is allowed as a deduction.

Section 194S

1% TDS on VDA transfers

Every deduction leaves a data trail.

Schedule VDA

Transaction-wise reporting in the return

A blank schedule beside TDS entries invites a mismatch.

The flat 30 percent tax applies without any deduction for expenses, and a loss on one asset cannot be set off against gains elsewhere.

Every transfer belongs in Schedule VDA with its acquisition date, transfer date, cost, and sale value. A loss is shown as nil there, so loss-making trades still need an entry.

The 1% TDS is not an extra levy. It counts as credit against final liability, which is why the figure in the return should line up with the TDS entries recorded under the taxpayer's PAN.

Crypto-to-crypto swaps count as transfers too, so a trader who never touched rupees can still owe tax. Gifts, mining, and staking rewards follow separate rules, which is a common source of confusion.

How Does a Taxpayer Respond to a Crypto Tax Notice?

Records come first after any crypto tax notice. Exchange statements, Crypto wallet histories, and TDS entries in Form 26AS help rebuild the year's trades, and traders who used several platforms, including low-fee Indian exchanges, need every statement merged into one record.

Gains are then worked out trade by trade. Many traders rely on crypto tax calculators to speed this up, although such tools do not replace advice from a qualified tax professional.

If the original return left out crypto income, the correction route depends on timing. A revised return works while that window stays open, and after it closes, the updated return facility under Section 139(8A) allows a late correction with additional tax that starts at 25 percent of the tax and interest due.

The department's own tutorial explains the time limits and how the additional tax rises with delay. Eligibility depends on the assessment year involved, so the filing window should be checked before any step is taken.

What Risks Come With Ignoring a Crypto Tax Notice?

Silence rarely makes a mismatch disappear, and an unanswered crypto tax notice can escalate. A few outcomes are possible when a gap stays unexplained:

  • Interest and late-filing charges keep building on unpaid tax, so a delayed correction usually costs more than one made early.

  • The Finance Ministry told Parliament that action in evasion cases can include notices, e-verification, reassessment, penalties, and prosecution.

  • Under-reported income may attract a penalty under Section 270A, which can reach 200 percent of the tax in cases of misreporting.

What Remains Uncertain About the NUDGE Drive?

Official numbers do not isolate the share tied to a crypto tax notice. A Lok Sabha reply on August 3, 2026, said all NUDGE campaigns together produced 1.25 crore updated or revised returns and Rs 9,494 crore in additional tax across FY 2024-25 and FY 2025-26.

Crypto also remains unregulated in India, according to the government's own Parliament reply, even though income from it stays taxable. That gap helps explain why outreach and data matching are doing most of the work right now, while regulatory developments keep appearing in the latest crypto market updates.

What Does the Crypto Tax Notice Wave Tell Traders?

The NUDGE drive is data-led outreach and not a ban. A crypto tax notice usually traces back to a mismatch between TDS data held by the department and what Schedule VDA shows.

What stays unclear is how many taxpayers actually filed corrections after crypto messages, since official totals blend every campaign together. Traders can compare their returns filed with Form 26AS, check the correction window for each assessment year, and confirm treatment with a tax professional.
