Sen. Cynthia Lummis (@SenLummis) says the $6.3 billion hack of Binance (@binance) shows why the CLARITY Act matters, as the incident revives debate in Washington over how to regulate crypto exchanges.

Lummis argued the bill would have given crypto firms legal cover to freeze suspicious transactions as soon as law enforcement asks. "Every minute lost is money gone for good," she wrote on Oct. 30, according to TokenPost.

What the CLARITY Act Would Change

The Senate draft of the bill contains two separate measures, according to TokenPost. Section 10203 would create a voluntary Treasury-run pilot for information sharing between government agencies and selected private firms, while Section 10305 would protect firms from private lawsuits over certain good-faith temporary holds. The same report notes the proposal would not require firms to freeze assets beyond what existing law demands.

The bill has stalled in the Senate. According to CoinTurk, it failed to clear a procedural vote on September 15, receiving 49 votes in favor and 50 against. Coingape reports the bill passed the House in 2025.

On the hack itself, Crypto Briefing reports that Binance coordinated with authorities and froze approximately $3 billion of the affected assets. TokenPost adds that the FBI attributed the theft to North Korea and identified the activity as TraderTraitor.

CFTC Pushes Federal Option for Offshore Exchanges

The hack has also sharpened calls for stronger federal oversight. CFTC Chair Michael Selig (@ChairmanSelig) said the incident reinforces the need for the agency's proposed crypto framework. Speaking to CNBC, he said the breach "proves our exact point" behind the rules the CFTC proposed earlier this month, according to Decrypt via Yahoo Finance.

Selig said offshore platforms lack safeguards found in U.S. markets. He said the agency wants to offer exchanges a path to register with the CFTC, which would subject them to cybersecurity safeguards similar to those in U.S. markets.

His reading of the attack is contested. Binance initially pointed to a compromised engineer's laptop but later said its investigation had found additional points of breach, and TRM Labs said the evidence points to a compromise of Binance's signing infrastructure rather than a blockchain weakness.

The two responses differ in approach. Lummis is pressing Congress to pass legislation, while the CFTC is pursuing a voluntary registration route through its own rulemaking. Bitcoin.com describes them as two competing regulatory arguments emerging from the same breach.
