With August now underway, crypto commentator Austin Hilton says the coming days may determine whether the Clarity Act advances before the U.S. Senate begins its scheduled recess or faces another delay until September.
Speaking in a video on X, Hilton described the legislation as one of the most significant developments for the digital asset industry, stressing that its progress could influence institutional participation and broader regulatory certainty. While he acknowledged ongoing market weakness, he maintained that the legislative calendar has become the primary focus for many crypto investors.
Senate Calendar Becomes the Main Obstacle
Hilton explained that the Clarity Act has already cleared several important stages. According to his update, the legislation has passed the relevant Senate committees, a merged draft has been released as the working bill, and discussions with the White House have resulted in agreement on revised ethics provisions.
Despite those developments, he said the biggest challenge is the limited time available before the Senate begins its August 8 recess. Hilton noted that lawmakers have a narrow window between August 3 and August 7 to hold floor debate, finalize revisions, and secure the procedural votes needed to advance the bill.
He added that if no action occurs before lawmakers leave for recess, consideration of the legislation would likely be postponed until September, extending the timeline for debate, amendments, and a final Senate vote.
Passage Odds Remain Uncertain
Hilton also shared his assessment of the bill’s chances of advancing. He estimated the probability of Senate passage during August at roughly 35% to 45%, reflecting what he believes is a more difficult political environment than previously expected.
Although he expressed reduced confidence in an August outcome, Hilton said he still believes the legislation has a stronger chance of passing before the end of 2026. He estimated those longer-term odds at approximately 65% to 75%, while noting that negotiations and political developments could still influence the final outcome.
According to Hilton, investors should monitor the Senate floor schedule, any revisions to the bipartisan ethics compromise, public commitments from undecided senators, and whether Senate leadership allocates sufficient floor time before the recess begins.
Market Performance Remains Tied to Broader Conditions
Alongside the legislative update, Hilton briefly discussed current market conditions. He noted that XRP had fallen about 2.9% over the previous 24 hours while the broader cryptocurrency market declined roughly 2.3%. He also pointed to weakness in Bitcoin and Ethereum, saying XRP’s recent price movement largely reflects the direction of the wider crypto market rather than asset-specific factors.
While Hilton acknowledged his frustration with the pace of the legislative process, he emphasized that regulatory clarity remains an important objective for the digital asset industry. He concluded that although the calendar makes an August breakthrough increasingly difficult, he remains optimistic that the Clarity Act can still advance before the end of the year if lawmakers reach the necessary political agreement.
