Patrick Witt stepped down as executive director of the White House Crypto Council on October 14, leaving the administration’s digital asset advisory team without staff. His temporary assignment from the Department of Defence officially ended, and the White House has not announced a replacement to coordinate crypto policy ahead of the November midterm elections.

Witt is the third senior crypto official to leave this year. Crypto Czar David Sacks departed in March, followed by Deputy Director Harry Jung in July.

His departure comes as the administration’s plans for crypto legislation have stalled. Witt was the main advisor on the Digital Asset Market Clarity Act, also known as the CLARITY Act. The bill was designed to divide oversight of the crypto industry between federal agencies.

Although the bill passed easily in the House of Representatives, it failed in the Senate last month after a procedural vote fell short of the 60 votes needed to move forward. Witt is expected to move into the private sector and resume his postponed military service with the Georgia National Guard.

Crypto legislation may stall with the exit

The passage of the CLARITY Act failed, mainly caused by political disagreements rather than problems with the proposed market regulations. On September 15, a vote to advance the bill failed by 49 to 50. The disagreements centred on stablecoin yields and ethics rules governing the president and his family’s digital asset holdings.

Without a dedicated council director to help negotiate a compromise during the upcoming lame-duck session, the chances of passing a clear federal crypto law in 2026 are now very low.

This leaves the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) with greater responsibility for overseeing the industry. Instead of operating under one clear legal framework, crypto businesses will continue to face regulation through enforcement actions and exemptions.

Some members of the crypto community are already lowering their expectations for federal legislation.

X user ETH MAXER said Witt’s departure makes it highly unlikely that the CLARITY Act or similar legislation will become law before the end of the year. The user suggested that the industry may have to wait until 2027 for another attempt.

Another X user, Bryan, pointed to the gap between the administration’s early political promises and its actual achievements. Bryan noted that despite two years of work and the appointment of multiple crypto czars, the government had failed to establish a strategic Bitcoin reserve. While praising Witt’s individual efforts, Bryan criticised the broader political failure to secure the country’s financial future.

Europe advances crypto rules as US legislation stalls

While progress in Washington has stalled, the lack of a clear US crypto policy is pushing some financial institutions to consider other jurisdictions. Institutions looking to develop digital asset products that comply with regulations are increasingly looking towards Europe.

The European Union’s Markets in Crypto-Assets (MiCA) framework has applied to stablecoins since mid-2024. The European Central Bank has also recently launched its Pontes network for settling transactions involving tokenised assets. This regulatory gap could encourage companies to develop their products in countries where the legal requirements are better defined.

The crypto market has also faced some uncertainty. Bitcoin recently fell below $82,000 after September’s consumer inflation data came in higher than expected.

The market decline has raised further questions about the gap between political promises and actual results. X commenter @Expired pineapple questioned how supporters of the administration were measuring its success. The user pointed out that although politicians describe the US as a crypto capital, the industry continues to struggle with scams, while Bitcoin is trading well below its all-time high.

With the White House Crypto Council now completely without staff, the administration has fewer resources to address these challenges. This could make it harder to tackle industry fraud and address regulatory disadvantages that may push digital asset innovation overseas.
